“The Court acknowledged the unlikelihood of Khalil’s detention under the Secretary of State’s determination, yet it did not rule out the legality of detaining him for other reasons,” the attorneys stated. “Khalil faces removal charges that are independent of the Secretary of State’s findings.”
Authorities claim that Khalil is being held for allegedly breaching a federal statute that renders any individual inadmissible if they have sought to obtain a visa or other benefits through fraudulent means. This legal framework is being utilized to justify his continued detention.

She stated, “The convoluted reasoning employed by the Trump administration to justify Mahmoud Khalil’s continued confinement underscores their willingness to manipulate legal standards to achieve their ends. This is a troubling precedent that jeopardizes individual rights.”
In response to the situation, a White House spokesperson asserted that Khalil had obtained his student visa through deceitful means and had engaged in activities that allegedly undermined U.S. foreign policy. They emphasized that the law empowers the Secretary of State to revoke the residency status of individuals deemed a threat to national interests.
